TELL ^a STORY – Terms & Conditions, version 3.0

Introduction

These are the TELL^aSTORY Terms & Conditions (referred to throughout as “TELL^aSTORY”, “we”, “us”, or “our”). They set out the rules for using, subscribing to, or purchasing our Services, how content is managed, and the rights and responsibilities of both you and TELL^aSTORY.

By registering an account, purchasing a subscription, or using our Services, you agree to these Terms & Conditions, forming a legally binding contract between yourself and BFLG Management AB on behalf of TELL^aSTORY.

1. Binding Contract

By accessing or using the www.tellastory.io website, portal, software, application, or any services provided by TELL^aSTORY (collectively, the “Services”), however accessed, you agree to be bound by these terms of use (“Terms & Conditions 3.0”).

When using our Services, you agree to:

• These Terms & Conditions.
• Our Privacy and Cookies Policy, governing how we collect, process, share, and store your personal data.
• Any supplementary rules, policies, or plan-specific terms made available to you.

Please print or save a copy of these terms for your records.

2. Amendments

We reserve the right to modify these Terms & Conditions at any time due to legal requirements, technical improvements, operational changes, the introduction of new features, or commercial adjustments.

• Notice period: we will notify you of intended material changes at least 30 days before they take effect, via the user interface, email, or other reasonable electronic means.
• Objections and cancellation: if you object to the updated terms, you may cancel your subscription or close your account before the effective date.
• Continued use: continuing to use the Services after updated terms become effective constitutes acceptance of the revised terms.

3. Account Types & Scope

Our Services cater to different categories of users:

• Visitors (free users): users who may only view publicly available content.
• Members (registered users): account holders who register to create public content, or access basic features by invite.
• Subscribers (paid account holders): account holders who purchase paid subscription tiers to unlock enhanced features, including private Life Story mapping and elevated storage and sharing capabilities.

This Contract applies equally to Visitors, Members, and Subscribers.

Account ownership and responsibilities

• Legal entity: you enter into this contract with BFLG Management AB.
• Business or commercial use: if you use the Services on behalf of a company, organisation, or commercial entity, you represent that you have the authority to bind that entity to these Terms.
• Non-transferability: you may not transfer your account or subscription to another individual or entity without our prior written consent. TELL^aSTORY may assign this Contract in connection with a merger, acquisition, or sale of assets.

4. Account Access & Security

The individual or entity associated with the primary email address and payment method on file is the Account Owner, and is responsible for all activity under the account.

Security rules

To keep your account secure, you agree to:

• Maintain the confidentiality of your login credentials and password.
• Provide accurate, current, and complete registration information.
• Refrain from creating multiple personal accounts, or creating an account for anyone other than yourself (a real person), except as a parent or guardian creating an account for your minor child.
• Refrain from bypassing, disabling, or interfering with security, authentication, or access-control features.

Inactivity and suspension

• Inactivity: accounts that remain inactive for more than 12 consecutive months may be archived or closed. We will give you notice before doing so, and you can keep an account active simply by signing in.
• Suspension: we reserve the right to suspend or terminate accounts suspected of identity theft, fraudulent activity, copyright infringement, or violations of these Terms.

Closing your account

You may close your account at any time from your account settings, or by contacting support@tellastory.io. A closure request does not take effect immediately. Your account stays open, and the request stays reversible, until its closing date:

• If you hold a TELL^aSTORY subscription, the closing date is the end of the period you have already paid for, so you keep what you have paid for.
• If you hold only a Life Story membership, the closing date is 5 days after your request.
• If you hold no subscription, the closing date is 30 days after your request.

You may reverse a closure request at any time before the closing date, either from your account settings or simply by signing in — signing in cancels a pending closure and restores any subscription that was cancelled alongside it. Once the closing date passes, the account is locked and can no longer be reversed or accessed.

Requesting closure cancels your subscriptions. Where you hold an annual Life Story membership and your closing date falls before the end of that year, the remainder of the paid period is forfeited.

5. User Content Classification, Licensing & Permissions

TELL^aSTORY allows you to document, map, and share your life stories, photos, videos, audio, text, location markers, and media (“Content”). You retain ownership of all Content you submit or upload.

When uploading Content, you must classify its visibility: PUBLIC, PRIVATE, or FOR SALE / COMMERCIAL.

A. Public content licence

For Content you explicitly classify as PUBLIC, you grant TELL^aSTORY a non-exclusive, fully paid, royalty-free, transferable, sub-licensable, worldwide licence to host, use, reproduce, modify, format, translate, publicly perform, publicly display, and distribute such Content in connection with the operation, promotion, and enhancement of the Service.

B. Private content and Life Story mapping licence

For Content you classify as PRIVATE — private life story maps, personal journals, restricted location pins, and invite-only stories:

• Strict operational scope: you grant TELL^aSTORY only a limited, non-exclusive, worldwide licence strictly necessary to store, host, process, format, back up, and transmit the Content to you and to individuals you explicitly authorise.
• No public distribution: private Content will never be made publicly searchable, indexed by search engines, or used in TELL^aSTORY promotional or marketing materials.
• Invite and QR code responsibility: private maps may be shared via private invite links, email invitations, or generated QR codes. You are solely responsible for managing who receives these links and codes. TELL^aSTORY is not liable if an authorised recipient forwards, exposes, or distributes your access link or QR code to third parties.

C. Eligibility and content promises

By submitting Content, you represent and warrant that:

• You are at least 12 years of age, or the minimum legal age required in your jurisdiction to use digital services without parental consent. Minors under 18 must use the Service under parental or guardian supervision. You confirm this when you register.
• You own or have secured all necessary rights, licences, and permissions — including copyright, trademark, and privacy consent for third parties depicted or referenced — to submit the Content.
• If logging location data or photos involving third parties, such as family, friends, or private property, you have obtained their explicit consent to log and share such data.

6. Subscriptions, Payments & Billing Terms

A. Subscription plans

Access to certain premium features — including private life mapping and expanded media storage — requires a paid subscription (“Subscription”).

• Billing cycle: subscriptions are billed on a recurring basis, monthly or annually as selected at signup, in advance of each billing period.
• Automatic renewal: your Subscription renews automatically at the end of each billing cycle unless cancelled before the renewal date. You authorise TELL^aSTORY and our third-party payment processors to charge the stored payment method for the applicable renewal fee and taxes.

B. EU/UK statutory right of withdrawal (14-day cooling-off period)

If you reside in the European Union, European Economic Area, or United Kingdom:

• You have a legal right to withdraw from a digital subscription purchase within 14 days of initial purchase without giving any reason.
• Immediate performance waiver: by subscribing and immediately accessing premium digital features, you explicitly consent to immediate performance of the Contract and acknowledge that you lose your statutory right of withdrawal once digital performance has commenced, to the extent permitted by law. Where required by law, prorated refunds for unexpired service periods will apply.

C. Cancellation, account lock and data retention (GDPR)

• Cancellation: you may cancel your Subscription at any time through your account settings or by contacting support@tellastory.io. Cancellation takes effect at the end of your current paid billing period, and you retain full subscriber access until that date.
• Access after the paid period: when the paid period ends, paid features and access to your private content and maps become unavailable. Read-only access is not maintained.
• Downloading your data: you can request a copy of your account data from your account settings at any time before your closing date. The archive is prepared in the background and delivered to your registered email address as a secure link that does not require you to sign in — so you can still retrieve it after your account has closed. The link remains valid until your data is permanently deleted. This packaged archive is a paid service; the fee is shown before you confirm. This does not affect your right under Article 15 GDPR to obtain a copy of your personal data free of charge, which you may exercise at any time by contacting support@tellastory.io.
• 60-day permanent deletion: in accordance with GDPR data-minimisation standards (Articles 5 and 17), your private content is permanently deleted from our primary servers and backups within sixty (60) days of your closing date — that is, from the date the account is locked, not from the date you requested closure. Once deleted, this data cannot be recovered.
• Content purchased by other members: where another member has bought Content from you, that Content is retained so the buyer keeps what they paid for. Your authorship is anonymised when your account is deleted, and the Content is no longer linked to you or to your profile.

D. Taxes and payment processors

All prices are subject to local value-added tax (VAT), sales tax, or exchange rate fluctuations based on your geographical location. Payment processing is facilitated through secure third-party payment providers. TELL^aSTORY does not store complete credit card account details on its servers.

7. Acceptable Use Policy & Restrictions

You agree that you will not use the TELL^aSTORY Services to engage in prohibited activities. You agree NOT to:

• Infringe intellectual property: post content that violates someone else’s copyright, trademark, trade secret, or privacy rights.
• Carry out unauthorised tracking or harassment: use private life mapping or location tools to track, stalk, record, or monitor any individual without their explicit, informed consent.
• Scrape or automate: extract, scrape, crawl, or harvest user profiles, public stories, or platform data using automated scripts, bots, spiders, or unauthorised web crawlers.
• Interfere with the system: hack, disrupt, introduce viruses or malware, reverse engineer, or overload TELL^aSTORY servers or security mechanisms.
• Exploit commercially: sell, rent, or commercialise access to TELL^aSTORY services, brands, logos, or content without express prior written approval.

8. Intellectual Property Rights

• TELL^aSTORY ownership: TELL^aSTORY, its logos, trademarks, portal design, software code, application interfaces, and proprietary algorithms are owned exclusively by BFLG Management AB and its licensors. Nothing in these terms grants you rights to use TELL^aSTORY branding, logos, or domain names without prior written authorisation.
• Third-party content: content published by other users remains the property of those respective users or creators. You may not copy, download, reproduce, or distribute other users’ Content outside the native sharing functionality provided by the Service.

9. Availability, Backup & Data Portability

• “As is” and “as available”: while we strive for high uptime and system reliability, TELL^aSTORY provides the Services on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee uninterrupted, error-free, or bug-free operation.
• Backup responsibility: TELL^aSTORY provides cloud hosting and sync services, but is not an archival backup service. You are strongly advised to maintain independent local backups of your critical media, photos, and journal entries.
• Data export: we provide account settings tools allowing you to export your uploaded stories, media, and private map logs in standard digital formats, as described in section 6C.

10. Warranties & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• NO WARRANTY: TELL^aSTORY AND BFLG MANAGEMENT AB DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
• LIMITATION OF LIABILITY: IN NO EVENT SHALL TELL^aSTORY, BFLG MANAGEMENT AB, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; ANY UNAUTHORISED ACCESS TO OR USE OF OUR SERVERS, PRIVATE LINKS, OR PRIVATE CONTENT; OR ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
• TOTAL LIABILITY CAP: IN NO CASE SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED EUROS (€100.00) OR THE TOTAL AMOUNT PAID BY YOU TO TELL^aSTORY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Governing Law & Dispute Resolution

• Governing law: these Terms & Conditions and any disputes arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of Sweden, without giving effect to conflict of law principles.
• Consumer protection: if you are an EU/EEA consumer, you also enjoy the protection of mandatory provisions of the law of your country of residence.
• Amicable resolution and venue: before filing a legal claim, you agree to contact us at info@tellastory.io to attempt to resolve the dispute informally. Any formal legal proceedings shall be brought before the competent district court in Stockholm, Sweden, or through the EU Online Dispute Resolution (ODR) platform where applicable.
